Shared Content Terms of Use

1. Overview

moodXplore allows users to share content as public webpages ("Shared Pages"). By creating or editing a Shared Page, you agree to the following terms. The default content is generated by our application, but you have the ability to edit it before sharing.

2. Your Content

2.1 Ownership

You retain ownership of any content you create or modify. However, by sharing content publicly through our service, you grant moodXplore a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your Shared Page as necessary to provide the service.

2.2 Responsibility

You are solely responsible for the content you share, including any modifications you make before publishing. moodXplore does not pre-screen Shared Pages and is not responsible for any content posted by users.

3. Prohibited Content

You agree NOT to create, upload, or share content that:

• Promotes, encourages, or facilitates illegal activities
• Violates any applicable laws or regulations

3.2 Harmful or Offensive Content

• Is defamatory, libelous, or fraudulent
• Contains hate speech or promotes discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or other protected characteristics
• Harasses, bullies, threatens, or intimidates any person or group
• Is sexually explicit, obscene, or pornographic
• Promotes violence, self-harm, or terrorism
• Exploits or endangers minors in any way

3.4 Intellectual Property Violations

• Infringes on copyrights, trademarks, patents, or other intellectual property rights
• Contains content you do not have the right to share

3.5 Privacy Violations

• Publishes personal information of others without their consent
• Contains confidential or sensitive data (passwords, financial information, etc.)

3.6 Spam and Abuse

• Is spam, unsolicited advertising, or promotional content not related to legitimate use
• Misuses the service to distribute unsolicited communications

4. Content Moderation

4.1 Automated Moderation

moodXplore does not manually review or pre-screen Shared Pages. However, we employ automated security systems that scan content for potential violations of these terms, including but not limited to malicious code, prohibited content patterns, and security threats.

4.2 Automated Enforcement

Our automated systems may, without prior notice:

• Block or filter content that violates these terms
• Remove Shared Pages flagged as harmful or in violation
• Temporarily or permanently suspend accounts that repeatedly or severely violate these terms
• Restrict sharing privileges

These automated actions are taken to protect our users and platform. You acknowledge that automated systems may occasionally produce false positives, and you may contact us at [email protected] to request a review of any automated action taken against your content or account.

4.3 Reporting

Users may report Shared Pages that violate these terms via [email protected]. Reports will be processed and may trigger automated or manual review.

5. Technical Restrictions

To protect users and our platform, Shared Pages are sanitized to remove potentially harmful scripts and code. Content that attempts to circumvent these security measures, include executable JavaScript, iframes, or external resource loading that could pose security risks is prohibited and will be automatically filtered or rejected.

If you believe content on a Shared Page infringes your intellectual property rights, please contact us at [email protected] with:

• Identification of the copyrighted work
• URL of the allegedly infringing content
• Your contact information
• A statement of good faith belief that the use is not authorized

7. Disclaimer of Warranties

Shared Pages are provided "AS IS" without warranty of any kind, express or implied. moodXplore does not endorse, guarantee, or assume responsibility for any user-generated content. We make no representations about the accuracy, reliability, completeness, or timeliness of any content shared by users.

8. Limitation of Liability

To the fullest extent permitted by applicable law, moodXplore shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Content created or shared by users
• Actions taken based on user-generated content
• Removal or deletion of Shared Pages
• Any unauthorized access to or alteration of your content

9. Indemnification

You agree to indemnify, defend, and hold harmless moodXplore, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the sharing feature
• Content you create, modify, or share
• Your violation of these terms
• Your violation of any third-party rights

10. Changes to These Terms

We may update these terms at any time by posting the revised version on our website. Your continued use of the sharing feature after such changes constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of France.
